White House Just Agreed On CLARITY Act Ethics β€” The Bill’s Biggest Roadblock May Be Gone

The most challenging roadblock to the CLARITY Act may have just been cleared. Eleanor Terrett of Crypto in America recently reported that multiple industry sources had told her the White House had agreed to an ethics package for the bill and sent the language to certain Senate Republicans. If confirmed through official channels, this development would represent the most significant breakthrough in weeks of stalled negotiations.

CLARITY Act Ethics DisputeΒ 

The ethics provision has been the central dispute holding the CLARITY Act back from a Senate floor vote since negotiations intensified this summer.Β 

Democrats have demanded enforceable language that would prevent the president, members of Congress, and their families from profiting off digital assets while in office β€” a demand that gained urgency after President Trump’s 2025 financial disclosure revealed more than $1.4 billion in crypto-related income.Β 

The disclosure put the administration in the uncomfortable position of negotiating ethics restrictions on its own financial interests while simultaneously pushing for the bill’s passage.

Senator Ruben Gallego of Arizona, one of the two Democrats whose votes the bill needs most, had said as recently as last week that the ethics language he had seen was “very weak” and that without meaningful protections the Democratic votes simply were not available.Β 

Whether the package the White House sent Monday addresses those specific concerns has not yet been confirmed publicly. But beyond ethics, the legislative picture is more mixed.Β 

Blockchain Association CEO Summer Mersinger told Terrett earlier on Monday she expects the Blockchain Regulatory Certainty Act (BRCA) provision to remain intact in the final text. She also indicated that the stablecoin yield language is unlikely to change significantly.Β 

Negotiations on the Agriculture Committee’s portion of the bill have continued, though Mersinger described those as largely down to technical edits at this point.

Sheriffs Call Crypto Cartel CurrencyΒ 

One complication that has not gone away is law enforcement opposition to the BRCA, Terrett wrote. The National Sheriffs’ Association released a video last week describing crypto as “the cartel currency of choice” and arguing the CLARITY Act would make criminal investigations harder.Β 

That framing directly complicates the path to securing two Democratic votes that remain genuinely in play β€” Senators Catherine Cortez Masto of Nevada and Mark Warner of Virginia.Β 

Both have signaled their support could hinge on whether law enforcement and Department of Justice concerns about illicit finance are addressed in the final text.

Negotiators supporting the bill have spent months countering the narrative that the CLARITY Act would enable criminal activity, and three law enforcement organizations β€” NOBLE, FLEOA, and the Major County Sheriffs of America β€” have shifted toward supporting the bill or moved from opposition to neutral.Β 

Industry leaders are still hoping for a floor vote as early as this week. Terrett’s reporting suggests the volume of unresolved issues makes that timeline highly unlikely β€” but the White House ethics agreement, if it holds and if Democrats accept the language, removes the single biggest obstacle the bill has faced. August 7 remains the deadline.
