Polymarket Is Now Taking Bets On Michael Saylor Facing Criminal Charges In 2026

Polymarket, one of the world’s largest prediction market platforms, has launched a new bet on whether Michael Saylor, the founder of Strategy, will face federal criminal charges before the end of 2026.Β 

What Is Actually Happening At StrategyΒ 

Strategy β€” previously known as MicroStrategy β€” has been under growing scrutiny as its financial position has deteriorated alongside Bitcoin’s (BTC) recent price decline below $59,000.Β 

The company’s current market cap sits at $29 billion, while the Bitcoin it holds (844,000 BTC) on its balance sheet is worth around $51 billion. The company’s Market-to-Net Asset Value ratio has now dropped below 1 for the first time. But that’s not all, Strategy’s unrealized mark-to-market loss has crossed the $13 billion mark.

Still, much of the market’s focus has been drawn by Rosen Law Firm’s recent announcement that it has opened a formal investigation into Strategy and its preferred stock STRC, over allegations that the company may have issued materially misleading information to investors.

The investigation centers on whether Strategy’s public communications about its Bitcoin holdings and business operations were transparent and fully compliant with disclosure regulations.Β 

Rosen Law Firm is preparing a class action lawsuit and has said investors who purchased Strategy securities may be entitled to compensation through a contingency fee arrangement, meaning no upfront costs are required to participate.

However, the Rosen Law Firm investigation and the Polymarket market are measuring two entirely different things. Rosen’s probe is a private securities class action, which is a civil matter.Β 

What Would Actually Make This Polymarket Bet Pay OutΒ 

As several social media users flagged on X (previously Twitter), investors suing a company for alleged misrepresentation is fundamentally different from the federal government bringing criminal charges against an individual.Β 

The Polymarket bet resolves “Yes” only on a federal criminal indictment of Saylor personally β€” meaning a formal charging decision by the Department of Justice (DOJ) or another federal prosecutorial body.Β A civil class action lawsuit, even if it proceeds to trial and results in a judgment against Strategy, would not cause this Polymarket market to resolve “Yes.”Β 

Ultimately, this means that the DOJ would need to independently investigate and decide to bring criminal charges against Saylor for the market to resolve in favor of those betting. As of now, there is no public indication that any such federal criminal investigation into Saylor exists.Β 

Still, the market is not entirely dismissing the possibility β€” Polymarket currently prices the odds of it happening at 14% at the time of publication.
