The CLARITY Act Has A Key Developer Protection Provision β€” Senator Wyden Wants It to Stay

Senator Ron Wyden has entered the CLARITY Act debate on the side of open-source software developers, urging Senate leadership to preserve a contested provision that would protect non-custodial Bitcoin (BTC) and crypto developers from being classified as money transmitters under federal law.Β 

The Oregon Democrat sent a letter Tuesday arguing that stripping the Blockchain Regulatory Certainty Act (BRCA) provision from the bill would create serious legal uncertainty for developers who build software but never touch user funds.

Wyden Says It Is Not That ComplicatedΒ 

Wyden’s position is that a developer who writes code but never controls a single dollar of user money is not a money transmitter, and treating them as one would be both legally incoherent and practically damaging to the US software development ecosystem.

The provision has become one of the most contested parts of the CLARITY Act’s path to a floor vote. Law enforcement groups, including the National District Attorneys’ Association, have written to Senate leadership arguing that the section containing that act as currently written would materially impair criminal investigations involving crypto.

Wyden pushed back on that framing. His letter argued that the BRCA does not create enforcement gaps β€” it simply draws a distinction that already exists in common sense and basic legal principle.

Developers who cannot move, hold, or block user funds are not in a position to facilitate financial crime in the way that exchanges, brokers, and custodians are, the Senator claimed.Β 

Requiring them to register and comply as money transmitters would not meaningfully advance law enforcement’s ability to pursue illicit finance. What it would do, Wyden argued, is drive open-source development offshore and expose software writers to legal liability for code they wrote but do not control.

CLARITY Act Has Until AugustΒ 

The CLARITY Act arrived at this point after passing the House in July 2025 by a 294-134 margin β€” the strongest congressional vote in favor of digital asset legislation in US history.Β 

The Senate Banking Committee advanced it 15-9 in May 2026, with two Democrats β€” Ruben Gallego of Arizona and Angela Alsobrooks of Maryland β€” crossing the aisle to support it.Β 

Both have since made clear that their floor votes are conditional on a satisfactory resolution of the ethics question, specifically the demand for enforceable language that prevents government officials from profiting personally from digital assets.

Section 604 is the second of three major unresolved disputes blocking the CLARITY Act. The third involves stablecoin yield β€” whether language in the bill’s current form would allow digital asset platforms to offer interest-equivalent returns outside the framework established by the GENIUS Act, which was signed into law in July 2025.Β 

The Senate returns from recess on July 13. Analysts and policy makers have identified the window before the August recess as the last realistic opportunity for the CLARITY Act to pass this year. Miss that window, and the legislation almost certainly carries over into 2027– or beyond.Β
